A message from HCS Director of Human Resources, Matt Blood:

I am sure many of you already have heard the news about the change in state law regarding retirees returning to work without sacrificing their pension.  This, indeed, was signed into law and effective immediately!  That is good news for retirees wanting to return to school employment and for districts like ours that have been experiencing applicant shortages. I have included an email below from Matt Schueller (Director of Government Relations for MASA) that explains the new law very well.  If you have questions, please feel free to reach out to HCS Director of Human Resources, Matt Blood via email: mblood@hamiltonschools.us to get answers. 

In a nutshell, retirees can return to work in any position except superintendent after a 30-day complete bona fide separation AND with no promise of reemployment.  

There is a $15,100 earnings limit per calendar year for the first 6 months of retirement.  After 6 months, there is no earnings limit.

Example #1: An employee retires effective July 1.  There is a 30-day separation.  On August 1, the employee decides to return to work and fills an open position with the district.  The employee can only earn $15,100 from Aug. 1 - December 31.  Because July 1 was the effective retirement date, this employee's 6 months ends December 31.  Starting January 1, he/she can have unlimited earnings and not fear losing their pension.

Example #2:  An employee retires effective October 1.  There is a 30-day separation.  On November 1, the employee decides to return to work and fills an open position with the district.  The employee can earn $15,100 from November 1 - December 31.  Because this employee has not reached the 6 months of retirement by the end of that calendar year, he/she has a new $15,100 limit starting January 1.  Once this employee reaches the 6-month period, he/she can have unlimited earnings and not fear losing her pension.
